State Representative John Kivela Discusses His Dark Store Legislation

109th Dist. State Rep. John Kivela (D-Marquette)

Marquette, MI – (Great Lakes Radio News) – 109th District State Representative John Kivela has introduced legislation in the State House addressing a portion of the so-called “dark store” issue.

Kivela joined the SUNNY Morning Show with Walt & Mike today to explain how the measure would help local governments that lose money when large commercial and warehouse stores successfully argue to the Michigan Tax Tribunal for a lower tax rate.

Kivela said his bill prevents negative use restrictions that prohibit occupancy or use of the property, when that goes against the lawful use of the property under local zoning rules.

He added that State Senator Tom Casperson has introduced a companion measure in the Senate that amends the General Property Tax Act, saying the true cash value of a property shall consider the highest and best use of the property, the vacant value of the property, and it’s value as improved.

Kivela added that the bills keep speculative evidence and assumptions out of the assessing and seeks fairness in the overall process.
