State Police post commander's drunk driving charges thrown out

MARQUETTE, MI – (Great Lakes Radio News) - A judge has thrown out a drunk driving charge against an Upper Michigan State Police post commander.

Lieutenant William Smith of the Gladstone post was arrested by Sault Ste. Marie police on July 7, after his personal vehicle ended up in a ditch and he refused field sobriety tests.

Police obtained a search warrant to administer a blood test which showed that the 43-year old Smith’s blood alcohol level was 0.13. The legal limit is 0.08.

The Chippewa County judge ruled the evidence was inadmissible since the search warrant was signed at the time by a non-acting magistrate of the courts whose status was unknown to officers.

Smith has been suspended with pay since his arrest. No word on whether he has been reinstated.

  1. Do you know if Mr. Smith has been reinstated. I have contacted by E-Mail Chippewa Sheriff, Judge M. Louma’s office, Attorney, the State Police Lansing, and the Governor’s office. Only the attorney responded. I ask whether Implied Consent was invoked and whether the Lt. has lost is drivers license and given 6 points as required under this law. Was told he would look into it.
